About Separation Law

Laws regarding legal separations deal with the rules that parties must follow when they are in limbo between no longer desiring to cohabit with their spouse but not wanting to seek an official dissolution of their marriage.

Legal Processes

In Connecticut, the process of a legal separation is the same as getting a divorce, custody orders are entered as well as the division of property and other financial orders. However, it prohibits either spouse from marrying someone else until such time as the Judgement of Legal Separation is converted to a Divorce.

Separation Agreements

Spouses can establish a legal agreement that divides their property, assigns their assets, provides instructions regarding their income and debts, establishes child support, and establishes spousal support. Our attorneys will discuss the advantages of obtaining a Legal Separation.

Conversion To Divorce Settlement

Our divorce lawyers can explain that Connecticut allows a couple to convert their legal separation to a divorce. This option is only available if the parties have not resumed marital relations. This process is not automatic and requires one of the spouses to submit a petition to the court asking for the legal separation to be converted to a judgement of dissolution of marriage.

Reconciliation

If the spouses resume marital relations and file a written declaration of reconciliation that is signed, acknowledged and witnessed with the court clerk, the decree for legal separation will be vacated and the complaint is deemed to be dismissed. This must be filed in the same court as the one that granted the Legal Separation.
